SERVICE AGREEMENT

We welcome and thank you for being a part of the Cabinet Solutions experience. This agreement is intended to clearly communicate the critical things that you expect of us and that we expect of you so we both succeed in our arrangement. We look forward to building and continuing our long term, mutually beneficial relationship.

This agreement is hereby made between Cabinet Solutions, LLC. hereinafter referred to as (Cabinet Solutions), and (The Customer). The terms of this agreement are not specific to a singular project and shall be binding upon The Customer and Cabinet Solutions for all future projects.

Upon scheduling of service , The Customer is in agreement to all terms listed below and shall automatically be applied by reference in each specific proposal, contract, change order, and job performed by Cabinet Solutions for The Customer, whether expressly referred to therein or not. In the event of any conflict between any terms and conditions contained herein and any terms and conditions contained in any proposal, contract, invoice or other document submitted by Cabinet Solutions, the terms of this Agreement shall control and govern.

CONTRACTS & CHANGE ORDERS

Assessments
The fee for a 30-minute assessment and/or initial evaluation is $50.00 for new customers and customers outside of the dealer/builder network. This amount will be absorbed into the base rate of the repairs if we accept and proceed with service upon acceptance of the project. Assessments will be good for up to 15 days. Failure to respond or coordinate service date within the 15 days will void the scope and you will need to reschedule for a new assessment and the assessment fee will apply. This is necessary because as time passes with regular use of your space it can incur additional damage that will cause the scope of the work to grow and/or change.

Estimates
Estimates best reflect the information provided, but nonetheless is an estimate and not a guaranteed cost for services. It is the  responsibility of The Customer to layout the scope fully and identify ALL areas for repair to a cabinet solutions representative to ensure an accurate estimate of labor & cost.

Change Orders
No additional work or changes shall be made once a job is scheduled unless specifically outlined in writing in the form of a change order and approved, which may result in one of the following scenarios.

  1. We will make an effort to accommodate and complete the original scope and added work within the allotted time and/or day which may result in a rate increase.

  2. If there is no room to make the adjustments this may result in scheduling a return visit to complete the added work which will result in additional fees, including a base rate.

  3. We will reschedule the service completely with an appropriate timeslot, you will be responsible for any rate increase associated with added labor time to complete the work as well as a rescheduling fee if made within the 48 hour window.

Site Arrangements / Preparations
The Customer agrees to the following and has acknowledged the environment is suitable and ready for us to service and we will not be prohibited from rendering service. Failure to comply or communicate on the following will result in cancellation with penalty. 

  • Newly Polyed floors are fully cured

  • All aspects of install are completed

  • Newly painted walls  are fully dried and cured

  • The premises is climate controlled

  • The premises has active electricity and NOT running on a generator

  • We will have access to active outlets to hook up any necessary equipment.

 

Supplies & Materials
Cabinet Solutions will supply all necessary materials to perform services unless specified otherwise.

 

Final Inspection & Services
Upon completion of services, the customer is responsible for participating in and/or reviewing the final inspection of the completed work. Any visible spots, areas requiring touch-up, deficiencies, or other concerns that are identified during the final inspection should be brought to our attention at that time so they may be addressed before the service is considered complete.

We are not responsible for spots, areas, or conditions that are not identified and reported during the final inspection. Once the final inspection has been completed and the customer has accepted the work, any subsequently reported spots, deficiencies, or requests for additional repairs or touch-ups will be considered a separate service request.

If the customer requests that we return to the property after completion of the service to address an item that was not identified during the final inspection, an additional service fee will apply. The applicable fee will be communicated to the customer either  prior to scheduling the return visit or during a scheduled assessment. Additional charges may also apply for materials, labor, travel, or other services required to complete the requested repair or touch-up.

The customer acknowledges that the purpose of the final inspection is to provide an opportunity to identify and communicate any concerns before the service is deemed complete. Our obligation to perform corrective work at no additional charge is limited to issues that are identified during the final inspection and that fall within the original scope of services.

BUSINESS PRACTICES

Schedules
Your business and all of our projects rely critically on a timely work schedule. We work normal business hours from 7:30 am through 4:00 pm, Monday through Friday. Each and every task relies critically upon completion of the tasks preceding it. Therefore, the customer is expected to adhere to an agreed upon work schedule. If The Customer  and/or its authorized representatives can not make the scheduled appointments and commitments, then The Customer shall contact the office at Cabinet Solutions for that project to make acceptable alternate arrangements.

Cancellations
The customer will be responsible for a fee of $100 for orders below $500 or 25% of a previously quoted amount if cancellation is less than 48 hours. This is necessary because a time commitment is made to you and is held exclusively for you. If you are late for a service beyond 30 minutes with no prior communication, your job may be rescheduled and you will be responsible for the late cancellation fee. Alternatively, if you are late and have communicated in advance, the service will be kept and you may lose time off of your scheduled service and/or pay the adjusted rate for the time we waited in addition to the service time. We understand that life happens and some things may happen outside of our control and may offer to waive eligible fees by an authorized member of management on a case-by-case basis.

 

Zones
Some areas may be subject to a zone fee if outside of a certain radius from our facility.

 

DISCLAIMERS

Preparations & Masking: We may need to protect surfaces around areas we repair with standard industry grade painters tapes, plastics and papers and therefore cannot be held liable for peeling or flaking from de-masking. We cannot be held liable for the careful removal of said tapes or equivalent. 

Application: Customers should accept that our application may appear / feel “less smooth” than what is delivered in a standard factory finish. Refinishing in batches (otherwise known as anything refinished separate from the initial processing of the parts outside of the factory) will result in slight variation in color, texture and/or sheen. Not all finishes are created equal. 

 

Cosmetic Repair: Touch-ups, also known as spot treatments are a cosmetic solution to various types of damage and/or defect and are not limited to  nick’s, dings, scratches, gauges, etc. These repairs are not intended to change the quality of the material nor provide any structural support to the areas. The application is focused on the surface and offers a blended repair to conceal imperfections. That doesn't always mean that the result will be "perfect", but often significantly better than what it was before and in accordance with standard industry practices.

 

Dust: We cannot be held liable for dust particles accumulated in the area from sanding. We make a conscious effort as part of our service to sweep and wipe down surfaces within the working vicinity that may have accumulated dust from servicing. This effort does account for particles that may  still be trapped in the air which could eventually settle within a few days. Please be mindful that a proper cleaning should take place 2 weeks post service. Most particles caught in the drying topcoat will be removed naturally with normal cleaning.

 

Odor: We use a wide range of finishing products that may produce a mild to strong odor, depending on quantity. Be mindful of your own sensitivities and communicate with Cabinet Solutions personnel in order to prepare accordingly for future service.

 

Schedules: The provided timelines for any given project are estimations and not guaranteed. We reserve the right to extend lead times as needed and will communicate any unforeseen delays accordingly.

 

 

DEFINITIONS

 

General Touch-up Services

Cabinetry touch-up services are intended to improve the appearance of localized cosmetic damage on existing cabinetry through targeted spot repair techniques rather than full refinishing or replacement. Typical touch-up work may include treatment of minor scratches, chips, scuffs, worn edges, finish inconsistencies, small stains, discoloration, nail holes, or other isolated surface defects. Services may involve color blending, filler application, sealing, sheen adjustment, and limited finish repair performed only in the affected areas. 

 

Because cabinetry ages naturally over time and existing finishes are subject to variations in color, texture, sheen, grain pattern, UV exposure, wear, prior repairs, and environmental conditions, touch-up work is inherently a corrective and cosmetic process—not a factory restoration. While every effort is made to achieve the closest possible visual match, an exact or invisible repair cannot be guaranteed. 

 

Clients acknowledge and understand the following expectations and risks associated with cabinetry touch-up services: 

1. Spot treatments are localized repairs only and are not equivalent to complete refinishing, repainting, or replacement of cabinet components. Color, sheen, and texture matching may vary under different lighting conditions and viewing angles. 

2. Repaired areas may remain partially visible upon close inspection, especially on darker finishes, stained wood, high-gloss surfaces, natural wood grain, thermofoil, laminate, or previously repaired areas. 

3. Touch-up materials may cure, oxidize, or age differently than the original factory finish over time. Existing damage, moisture exposure, heat exposure, structural movement, swelling, peeling, delamination, or substrate deterioration may limit achievable results. 

4. Certain finishes and materials may have limited repairability, and some damage may not be fully correctable without more extensive refinishing or replacement. 

5. Additional imperfections may become more noticeable once the primary damaged area has been improved. 

6. Touch-up repairs are cosmetic in nature and do not restore original manufacturer condition, value, or warranty coverage. 

 

The goal of cabinetry touch-up services is visual improvement and damage reduction to a commercially reasonable standard. Final results should be evaluated from a normal standing viewing distance under standard lighting conditions, rather than at close-range inspection.

 

Cabinet & Furniture Refinishing and/or Restoration
Full Kitchen Refinishing means the professional preparation and refinishing of the existing kitchen cabinetry, including cabinet doors, drawer fronts, and cabinet frames/boxes, as specified in the project assessment. The process may include removal of doors and drawers, cleaning/degreasing, sanding or surface preparation, minor cosmetic repairs, priming, application of cabinet-grade coatings, and reinstallation of the finished components.

Full kitchen refinishing does not include cabinet replacement, major structural repairs, replacement of damaged or swollen materials, new hardware, or interior cabinet refinishing unless specifically stated in the written estimate. Existing imperfections, wood grain, seams, dents, or other substrate conditions may remain visible after refinishing.

WARRANTY & FAILURE TO PERFORM:

Warranty: We strive to meet the industry standard for quality workmanship and therefore provide the customer with a twelve (12) month written warranty on applicable completed projects. 

 

Our warranty is valid upon full payment to Cabinet Solutions for services rendered at our facility and/or products sprayed at the jobsite. Please note that our warranty is specifically related to the two things under our control: Workmanship and Product Defects. Our warranty is based on the understanding that a refinished surface can only be breached by an outside source. This warranty covers bubbling, blistering, and peeling (if this happens, it'll be easy to recognize within the first few months) due to workmanship or product defects, during normal residential use. Cabinet Solutions warrants that all the work we perform will be free from cracking, peeling, or any workmanship or product defect not caused by neglect, abuse, mistreatment, or normal wear and tear  from the date of completion for a period of twelve (12) months. If any of our work does require a touch-up, and falls within the limits of this warranty, all work and materials will be supplied at no additional cost.

 

Warranty does NOT cover any sort of physical damage, moisture damage, and/or chemical damage. Our warranty does NOT cover the natural aging of cabinets or expansion joint cracks from natural expansion and contraction of the material. 

 

Newly finished areas normally need 48 HOURS to cure thoroughly enough to handle delicately and you should refrain from cleaning the surface for this period of time. The finish is completely cured in 14 days.

GOVERNANCE

 

Governance: This Contract shall be construed in accordance with the laws of the Commonwealth of Massachusetts. The provisions of this contract shall not be changed, altered or modified except in writing signed by both parties. THE PARTIES HERETO WAIVE THEIR RIGHT TO TRIAL BY JURY IN ANY DISPUTE BETWEEN THEM TO THE MAXIMUM EXTENT PERMITTED BY LAW.
